Abstract : According to the Federal Constitution, the governance of waqf properties is under the jurisdiction of the states. Nowadays, there are problems in the governance of waqf properties in Malaysia in terms of legal, management and operational aspects that require a study on them. This study is about the Transformation of Waqf Property Governance Nowadays covering these three aspects. The objective of the study is to identify the factors that affect the current governance problems of waqf properties, determine the management strategy and formulate an improvement model or dimension to overcome the problem. The methodology of the study is through a descriptive qualitative method involving purposive sampling techniques through individual depth interviews with five study informants who are experts in the field of waqf management and jurisprudence, shariah and civil law. The findings of the study related to the factors influencing the current waqf governance problems were identified as legal aspects, sources of power, functions and obligations and human resources. However, the journal only discusses the legal aspects including the no specific legislation on waqf land compared to the National Land Code 1965.

Mengikut Perlembagaan Persekutuan, tadbir urus hartanah wakaf adalah di bawah bidang kuasa negeri. Pada masa kini, terdapat masalah dalam tadbir urus hartanah wakaf di Malaysia dalam aspek perundangan, pengurusan dan operasi yang memerlukan kajian terhadapnya. Kajian ini adalah mengenai Transformasi Tadbir Urus Hartanah Wakaf Masa Kini meliputi tiga aspek tersebut. Objektif kajian adalah untuk mengenal pasti faktor-faktor yang mempengaruhi masalah tadbir urus hartanah wakaf masa kini, menentukan strategi pihak pengurusan dan merumuskan model atau dimensi penambahbaikan bagi mengatasi masalah tersebut. Metodologi kajian adalah melalui kaedah kualitatif secara deskriptif melibatkan teknik purposive sampling secara temu bual mendalam (individual depth interview) terhadap limat informan kajian yang pakar dalam bidang pengurusan dan perundangan wakaf, syariah dan perundangan sivil. Dapatan kajian berkaitan faktor-faktor yang mempengaruhi masalah tadbir urus wakaf masa kini dikenalpasti adalah aspek perundangan, punca kuasa, fungsi dan obligasi dan sumber manusia. Namun, penulisan jurnal hanya membincangkan aspek perundangan termasuk faktor ketiadaan perundangan khusus mengenai tanah wakaf berbanding Kanun Tanah Negara 1965.
